Arkadia Marketing Limited, a company registered in Malta, bearing company registration number C 11113 and having its registered address at Mizzi Organisation Corporate Office, Testaferrata Street, Ta' Xbiex, XBX 1407, Malta, (“We,“Us”,“Our”) operates the Prima Arkadia Foodstore and Arkadia FoodExpress Loyalty Scheme (“Scheme”) which permits you to accrue points as a result of your purchases at the Arkadia Foodstore/ Arkadia FoodExpress (“Store”), which points may be redeemed against awards that are made available by Us from time to time.

Joining the Scheme is subject to your agreement to the following Terms and Conditions (“T&Cs”) and the Prima Privacy Policy (“Privacy Policy”).

If you are already a member of the Scheme, your agreement to these T&Cs and the Privacy Policy is required for you to remain a member of the Scheme and continue to benefit from the points you may have accrued.

1. Membership to the Scheme is open to any person aged eighteen (18) years or over with a residential address in Malta or Gozo. Persons below the age of eighteen (18) years require their parent's or legal guardian's consent before applying (“Parental Consent”). Parental Consent shall be granted by the parent/legal guardian signing the application form which shall also include Name, Surname (in caps) and his/her mobile number. We shall verify the Parental Consent received by contacting the parent/legal guardian by [email/SMS].

2. Companies or other legal entities cannot apply to become members of the Scheme.

3. Only one (1) person can enrol as a member per application. Membership is strictly personal and We reserve the right to terminate membership or cancel any points which may have been accrued at any time and without cause (without recourse against Us and without Us incurring any liability towards you). If We terminate your membership, all points which you may have accrued shall be automatically lost.

4. Loyalty Cards and loyalty points are valid for a period of 12 months from the date they are earned. Points will expire on a first-in, first-out (FIFO) basis. If your account has no point-earning activity for a continuous period of 12 months, it will be deemed inactive, and We may close the account and remove all personal data in accordance with Our Privacy Policy.

5. By applying for membership, you authorise Us to process your personal data for the purpose of the Scheme in accordance with the Privacy Policy. Your failure to agree to Our Privacy Policy impedes Us from being in a position to allow you to become a member of the Scheme.

6. Your membership commences on the date that the application form, duly filled and signed, is presented to Us or to any of Our authorized outlets. If you are under the age of eighteen (18) years, you will only become a member after the Parental Consent has been verified by Us.

7. Points start to accumulate upon commencement of membership and by purchasing products within the Store.

8. Members are to communicate their ID number at point of purchase for points to be awarded.

9. The points accumulated on the Prima Loyalty Cards are the property of Arkadia Marketing Ltd, and the company reserves the right to withdraw such points or any other scheme at any point in time, without the need to give any prior notice.

10. Loyalty points can be redeemed for vouchers as outlined on the Prima's website (prima.com.mt)

11. All awards are subject to availability. We will endeavour to keep members informed on the awards available, however, awards may be changed without prior notice and availability of any award remains subject to Our sole discretion.

12. Points accumulated by any one (1) member may not be used in conjunction with points accumulated by other members, neither are points transferable from one (1) member to another member.

13. Points which are not redeemed before one year of last purchase from any Arkadia Foodstore outlets will be lost.

14. We may modify these T&Cs from time to time. We will provide you with at least 30 days' prior notice of any material changes via email and/or by posting a notice in our stores and/ or on our website. Your continued participation in the Scheme after the effective date of the changes constitutes your acceptance of the amended T&Cs. If you do not agree to the changes, you may terminate your membership and redeem any accrued points within the notice period."

15. To the full extent permitted by Maltese law, Our total liability to you in connection with this Scheme shall be limited to the value of the points in your account. We shall not be liable for any indirect, special, or consequential damages, or for any loss of profit or loss of data. We shall not be held liable for any failure or delay in performing Our obligations under these T&Cs where such failure or delay results from events, circumstances, or causes beyond our reasonable control, or a Force Majeure Event.

16. If any of the provisions of these T&Cs becomes illegal, invalid or unenforceable in any respect, the legality, validity and enforceability of the remainder of these T&Cs shall not be affected.

17. These T&Cs are governed by and construed in accordance with the laws of Malta. Any dispute in connection with these T&Cs shall be subject to the exclusive jurisdiction of the courts of Malta.
